Chapter 7 Liquidation
Under Chapter 7, most unsecured consumer debts are simply extinguished, wiped away and you will no longer owe the debt. On such debts that are secured like home mortgages and automobiles, as long as you are current on the payments, you can reaffirm the debt and stay in your home or continue to own your car (as long as you keep your payments current). If you wish to surrender the collateral and walk away from the debt, that option is also available. A Chapter 7 bankruptcy will allow you to walk away from your credit card balances, medical bills, unsecured lines of credit and unsecured promissory notes and get a fresh financial start. It will stop the harassing phone calls, stop the collection agencies and it will stop the lawsuits.
Chapter 13 Personal Reorganization
Under Chapter 13, you will be protected from your creditors while you reorganize your finances and work out a plan where you repay your creditors over time. These plans even stop IRS garnishments. A Chapter 13 bankruptcy can stop home foreclosures and vehicle repossessions. In many cases you will only pay a smaller percentage of the unsecured debt back over the course of a 3 to 5 year plan. You can keep your home and your vehicles in spite of being behind on your payments. Each plan is tailored to your individual circumstance and the disposable income available to apply towards the plan.
Chapter 11 Business Reorganization
Under Chapter 11, you will have the chance to save your business by keeping your creditors at bay while devising a plan of reorganization. The automatic stay that goes into effect when the bankruptcy is filed can protect your business from its creditors and give you time and opportunity to regroup and prepare a plan of reorganization. Many companies have reorganized under Chapter 11 and come out the other side of bankruptcy and gone on to be successful.
